1. Acceptance of Terms

By accessing or using the exeye application (“App”), you agree that you have read, understood, and are bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the App.

2. Description of the Service

• exeye: exeye is an AI-assistant application developed by Dominic Black. You interact with it in natural language to set up automations.

• Smart Alerts: You can ask exeye to watch for a real-world or website change, such as a product going on sale, tickets becoming available, or a web page being updated, and it will notify you when it detects that the change has occurred.

• Scheduled Summaries: You can ask exeye to generate and deliver recurring content on a schedule, such as a daily lesson, a workout, a challenge, or a news digest.

• AI-Generated Content: The assistant’s replies, alert evaluations, and generated summaries are produced by automated AI systems and may draw on live web searches. This content may be inaccurate, incomplete, or out of date, and should not be relied upon as professional, financial, medical, legal, or other expert advice.

• Best-Effort Monitoring: Smart Alerts are checked periodically and are provided on a best-effort basis. We do not guarantee that a monitored change will be detected, that a notification will be delivered, or that either will happen within any particular time. Do not rely on exeye for time-critical, safety-critical, or financially critical decisions.

3. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the App. By using the App, you represent that you have the legal capacity to enter into this agreement.

4. User Accounts

• Account Registration: To use the App you must create an account with a valid email address and password. You agree to provide accurate and complete information and to keep it updated.

• Account Security: You are responsible for safeguarding your credentials. We are not responsible for any loss or damage resulting from unauthorized access to your account.

• Termination: We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in activities that harm other users or the App.

5. Credits, Subscriptions and Payments

• Credits: The App uses a credit system to meter usage of its AI features. Free accounts receive a periodic credit allowance. Running the assistant, evaluating alerts, and generating summaries consume credits. When you are out of credits, those features are paused until your allowance refills or you obtain more credits.

• Premium and Top-Ups: You may purchase an optional premium subscription for a larger recurring credit allowance, or one-time credit top-up packs. Payments are processed securely through the Apple App Store or Google Play Store and managed via our subscriptions provider. We do not store or process your payment details directly.

• Billing: Subscription renewals are managed by the respective platform (Apple or Google). Please review their terms for cancellation and refund policies.

• Refunds: All payments are non-refundable except as required by applicable law or store policy. Credits have no monetary value, are not redeemable for cash, and are non-transferable.

6. Acceptable Use

You are responsible for the automations you create and the instructions you give the assistant. You agree not to use the App to:

• • Violate any applicable law, regulation, or third-party rights;
• • Monitor, scrape, or access any website or service in violation of its terms of use or applicable law;
• • Attempt to gain unauthorized access to our servers or data, or to other users’ data;
• • Abuse, overload, or attempt to circumvent the credit system or usage limits;
• • Upload malicious code or use the App to create harmful, deceptive, or abusive content.

7. Intellectual Property

• Ownership: All content, code, graphics, text, and designs within the App are the exclusive property of Late Dominic Black or its licensors.

• License: We grant you a limited, revocable, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, or distribute any part of the App without our written consent.

8. Disclaimer of Warranties

The App is provided “as is” and “as available.” We make no express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, or reliability.

We do not warrant that the App will be error-free, uninterrupted, or secure, that alerts will trigger or notifications will arrive, or that AI-generated content will be accurate. You use the App at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, Dominic Black and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill, or for any decision made or action taken in reliance on the App or its AI-generated content, arising from or related to your use of the App.

Our total liability for any claim shall not exceed the amount paid by you (if any) for the App during the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Dominic Black, its affiliates, officers, and employees from any claims, damages, losses, liabilities, and expenses arising out of your use of the App, violation of these Terms, or infringement of any rights of another person.

11. Updates and Modifications

We may modify or update these Terms at any time. The “Last Updated” date will reflect the latest version. Continued use of the App constitutes acceptance of the revised Terms.

12. Termination

We reserve the right to suspend or terminate access to the App, with or without notice, for any reason, including violations of these Terms or misuse of the App.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in New South Wales.

14. Miscellaneous

If any part of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right.
